— A town resident was killed in a crash late Saturday when a driver pulled out in front of his motorcycle, the Saratoga County Sheriff's Department reported.

Matthew W. Phillips, 22, of Providence was riding south on Barkersville Road at 10:22 p.m. when Nicholas R. Merrifield, also a 22-year-old Providence resident, stopped at the stop sign at the Glenwild Road intersection then pulled into Phillips' path without yielding, investigators said.

Phillips was pronounced deceased at the scene by Saratoga County Coroner Susan Hayes. Merrifield was not injured.

Sergeant Bortell and Deputy Lyons conducted an accident reconstruction Sunday and determined that speed was not a factor in the incident. Merrifield was issued a traffic summons charging him with failure to yield right of way.

This should be submitted for the DA for an indictment for criminally negligent homocide.
