NY venue changed to Schoharie County for new murder trial
ALBANY — The third murder trial of a once-prominent auto dealer has been moved to another upstate New York county after defense lawyers argued he couldn't get a fair trial where he was twice convicted.
An Appellate Division panel, without comment, is moving Calvin Harris' next trial to Schoharie County.
His first two convictions were overturned. The Court of Appeals faulted the judge's handling in the second trial of hearsay testimony and a juror who acknowledged having a pre-existing opinion.
Harris was convicted of killing the mother of their four children during a fractious divorce. Her body was never found.
Michele Harris, then 35, was last seen leaving work the evening after the Sept. 11, 2001, terror attacks.
Attorney Bruce Barket says Harris, now out on bail, has been raising his children.
