Schenectady police are seen parked outside the 23 Mynderse St. home of Gloria Nelligan (inset) on Feb. 25. Nelligan was charged with murder by a grand jury today in the death of her 8-year-old grandson, Sha'hiim.

— The woman accused of beating her 8-year-old grandson to death last month was notified that she has been indicted by a grand jury, a prosecutor confirmed Thursday.

Gloria Nelligan, 43, of 23 Mynderse St., appeared in City Court on Thursday morning for a possible preliminary hearing in her case. Instead, she was informed of the indictment, which sends the case to Schenectady County Court and cancels the hearing, prosecutor Christina Tremante-Pelham confirmed.

The contents of that indictment, however, remain sealed until it is handed up.

Nelligan has been in custody since her Feb. 24 arrest in the death of 8-year-old Sha’hiim Nelligan, who died the day before. Nelligan was charged with first-degree manslaughter, a felony that could send her to prison for as much as 25 years if convicted. She is represented by Schenectady County Public Defender Mark Caruso.

She is accused of beating her grandson to death “over a prolonged period” the evening of Feb. 22 and into the morning of Feb. 23. She was his legal guardian.

Court papers indicate the charge was based on statements from Nelligan, as well as the statements of witnesses and results of the police investigation.

Sources have said an incident earlier that week may have led to the beating. Sha’hiim apparently took a pack of gum from a nearby store and his grandmother found out. She then took him back to the store and made him apologize, the source said.

Nelligan, though, didn’t leave it at that, the official said, and her anger spilled over that Friday, resulting in Sha’hiim’s death Saturday.
