Glens Falls dad gets maximum in son's death
QUEENSBURY — A 30-year-old upstate New York man has been sentenced to 25 years to life in prison for the murder of his toddler son.
Local media outlets report that Gary Waite of Glens Falls offered no apology at his sentencing Thursday for the death of his 15-month-old son, Jesse Smith. The boy died of a head injury after being hospitalized on Feb. 13, 2012.
Waite told investigators the boy fell, wouldn't stop crying, and then hit his head when Waite threw him on a couch and he bounced onto the floor.
District Attorney Kate Hogan presented three medical experts who testified the boy's injuries were too severe to have been caused that way.
Waite's lawyer is appealing the conviction.
