Alleged drunken driver charged with assault in August crash in Clifton Park
A Saratoga Springs man was arrested on felony vehicular assault charges Friday, more than three months after allegedly causing a car accident while under the influence of alcohol and marijuana.
The afternoon of Aug. 22, Daniel Stack, 25, was driving his 2009 Honda Civic westbound along Route 146 in Clifton Park when he crossed over the double solid line and struck a 2007 Toyota Camry head-on, police said. The Camry was driven by Ertugrul Berkcan, 63, of Clifton Park.
Both drivers had to be extricated from their vehicles by emergency responders and flown by helicopter to Albany Medical Center with what state police described at the time as serious injuries. Following the accident, a test revealed Stack had a blood alcohol content of 0.10 percent and had used marijuana at some point before the crash.
Stack now faces charges of felony vehicular assault, misdemeanor driving while intoxicated, driving while ability impaired by drugs and driving while ability impaired by the combined influence of drugs and alcohol, along with unlawful possession of marijuana.
He was released on an appearance ticket and is due to appear in Clifton Park Town Court on Wednesday.
