Apartments eyed near Northway Exit 12

Four buildings slated for Saratoga Village Boulevard

— A 200-unit apartment complex proposed on Saratoga Village Boulevard could become the first project to be approved under Malta’s new downtown zoning code.

The project proposed by Hayes Development Company of Saratoga Springs includes four 50-unit, three-story apartment buildings and a clubhouse with indoor swimming pool and would be built on vacant land opposite the Malta Commons Business Park.

The project is intended to appeal to employees of GlobalFoundries, State Farm Insurance and other local businesses, said Robert A. Hayes, president of Hayes Development.

“Certainly GlobalFoundries tenants are among those we could look to, but we’d look to the greater Capital Region as well,” Hayes said after a meeting Tuesday with the Malta Planning Board.

Under the form-based downtown zoning code adopted in February — which is unique in New York state — projects that meet the code’s rigorous standards can be approved administratively by the town Building and Planning Department, though the Planning Board has input.

The Planning Board did not raise significant concerns about the Hayes project, which would be located in an area the town has designated for dense residential development.

“I think we feel comfortable with how it’s envisioned in this zone,” said town Senior Planner Sophia Marruso. “It’s in substantial compliance with the form-based code.”

The only issues are technical ones that can be resolved through discussions between engineers, she said.

Hayes said he hopes to start clearing the 8.8-acre site this winter and have the project ready for tenants to move in by late 2014 — around the time GlobalFoundries will be finishing a new technology development center that will employ about 1,000 people.

“We want to meet the pending demand from the TDC,” he said.

The complex would charge market-rate rents, he said, and would remain under Hayes Development’s ownership and management after construction.

According to a project summary, the average unit size will be about 950 square feet, with 144 one-bedroom and 56 two-bedroom units in the complex.

Both surface and underground parking are included, with one underground parking spot per apartment.

Neighboring landowners are supporting the plan.

“I feel it will be an asset to the town,” said Scott Lansing, who owns the commercial Bluth Building on Route 9.

“As adjoining neighbors, we feel Robert and his team have done an excellent job,” said Terry Field, who represents the Park Place at Malta housing development, which is partially constructed.

Also at Tuesday’s Planning Board meeting, the board granted cluster subdivision approval to Cramer Road North, a plan for a 78-unit townhouse development on Cramer Road west of Route 9, north of the Highpointe at Malta senior citizen complex.

The project has been under review for several years due to wetlands on the 80-acre site and other limitations. Only about one-third of the site is going to be developed.

Lansing, who as a professional engineer is representing project developers Thomas Deveno and Thomas Farone, said plans for one of two commercial lots on Route 9 have been dropped because a Native American archaeological site was identified on the land. The second commercial lot is still planned.

The Planning Board approved the subdivision on the conditions that the archeological site be protected and other regulatory agencies approve the plans.

The plans will still need final site plan approval from the Planning Board, but Lansing said the subdivision approval will allow him to apply for needed state Health Department reviews.
