Tenants appeal to city leaders
Council eyes law to make landlords register properties

— Coreen Morey and Arlene Vallee have to leave their apartment in the next few days.

Their building at 218 E. Main St. has been condemned, deemed uninhabitable by city Fire Chief Richard Liberti two weeks ago.

The women have a list at least five pages long of code violations, after city housing inspector Thomas McQuade inspected the building Aug. 13.

“I’m just so overwhelmed with all the problems that I don’t know how to express myself,” Morey said at the last Common Council meeting.

Morey said she had tried to contact the landlord multiple times to fix the various problems with the building, but to no avail.

“We have a huge problem with out-of-state landlords here,” she said.

Liberti said the file he has about the property is 12 pages long and includes problems with the three-story, brick building’s plumbing and heating. There are leaks, holes in the walls and a lack of electricity in public stairways and to fire detectors.

“It doesn’t seem like [the property owners] are doing anything to rectify the situation,” Liberti said.

Liberti sent a notice to the property owners on file, Lizansk Partners LLC, with a P.O. Box in Harriman, and scheduled a hearing for 9 a.m. Thursday.

Representatives from Lizansk Partners never showed up.

Liberti said his next step is to send another message saying representatives from Lizansk Partners failed to appear, the property is still uninhabitable and if they don’t make repairs the city will do what’s necessary to make the property safe and sue them in court for any costs incurred.

Liberti said this is not that unusual for properties around the city, especially the difficulties officials have with contacting limited liability corporations.

“This is why the council members and the mayor have been advocating for a form of property registration for at least the rental units for those people who do not live in Montgomery County,” Liberti said.

Property registration legislation was first introduced at the beginning of the year by Alderman Joseph Isabel, R-1st Ward as a way to ensure the safety of the city’s tenants.

Corporation Counsel Gerard DeCusatis said he is still working to draft formal legislation, which he said would probably be a city ordinance, and said he should have something ready by the Common Council’s next meeting Tuesday.

DeCusatis said the legislation would not eliminate situations like the one Morey and Vallee are in, but should help reduce the occurrences.

He said the main problem will be the implementation of the system.

“It’s not going to be a magic bullet, but it will help,” DeCusatis said.
