SYNOPSIS OF EMINENT DOMAIN PROCEDURE LAW DETERMINATION AND FINDINGS In accordance with Sec- tion 204 of the New York State Eminent Domain Procedure Law, a synop- sis is hereby given of the Determination and Find- ings regarding the acqui- sition of real property rights required for PIN 1758.97, North Main Street over Anthony Kill Bridge (BIN 2202940), City of Mechanicville, County of Saratoga, State of New York. THE PUBLIC BENEFITS, USE, OR PURPOSE TO BE SERVED BY THE PRO- POSED PUBLIC PROJECT ARE: The public use to be served by the proposed public project is the re- placement of the North Main Street Bridge over the Anthony Kill. The North Main Street Bridge is owned and maintained by the City of Mechan- icville. The benefits to be ob- tained and purposes to be served by the pro- posed public project are as follows: a. Structural Deficien- cies. The existing struc- turally deficient bridge that carries North Main Street over the Anthony Kill would be completely removed and replaced on the existing horizontal and vertical roadway alignment. The replace- ment structure would be designed to current structural /safety stan- dards and provide a serv- ice life of 75 years. b. Hydraulic Design. The selected structure type will improve the hy- draulic conditions of the site for the passage of high stream flows. Por- tions of the retaining wall in close proximity of the bridge will be recon- structed as necessary. c. Pedestrians. Pedes- trian safety will be im- proved with ADA compli- ant sidewalk reconstruction within the project limits. THE APPROXIMATE LO- CATION FOR THE PRO- POSED PUBLIC PROJCET AND THE REASONS FOR THE SELECTION OF THAT LOCATION: The proposed public project is located in the City of Mechanicville, Saratoga County, New York. The project limits extend from the intersec- tion of North Main Street and Hill Street on the west to the intersection of North Main Street with Terminal Street on the east. Three alternatives were considered for the pro- posed public project. The reasons for selecting Al- ternative C, and for re- jecting the other alterna- tives include: a. The No Build Null alternative was rejected because it would not ad- dress any of the project objectives. b. The Rehabilitation Alternative does not sat- isfy the project objec- tives. The structural re- pairs would not address the deficiencies of the existing hydraulic open- ings, nor significantly ex- tend the service life of the bridge. c. The Replacement Al- ternative will eliminate the existing structural deficiencies, be designed to current structural and safety standards to pro- vide a service life of 75 years, and improve the hydraulic conditions of the site for the passage of high flow events. This alternative best satisfies the project objectives and is considered the most feasible alterna- tive. THE GENERAL EFFECT OF THE PROPOSED PROJECT ON THE ENVIRONMENT AND RESIDENTS OF THE LOCALITY: The proposed project un- derwent a thorough and proper review in accor- dance with the National Environmental Policy Act (NEPA) and the State En- vironmental Quality Re- view Act (SEQRA). The project is being pro- gressed as a NEPA Class II Action, Programmatic Categorical Exclusion be- cause it will not individu- ally or cumulatively have a significant impact on the environment. As Lead Agency under SEQRA, the City of Mechanicville de- termined the proposed project is classified as a Type II Action under the SEQRA, Part 617, Title 6 of the Official Compilation of New York Codes, Rules, and Regulations (6 NYCRR Part 617). As a re- sult, no further SEQRA processing was required. The proposed public project will have, among other things, the follow- ing temporary effects upon the residents of the locality: a. Vehicular traffic near the North Main Street Bridge will be forced to use the offsite detour route. The street closure and designated detour will be temporary, and will only apply during construction activities within the area. b. Pedestrian and rec- reational traffic will also be detoured around the active construction site utilizing a temporary de- tour bridge that will be constructed immediately to the east of the vehicu- lar bridge. c. Temporary increases in noise levels may also be noted by nearby resi- dents; however, con- struction noise will be minimized to the extent possible and will only be noticeable during the hours of active construc- tion (day time). RESOLUTION The foregoing Determi- nation and Findings were adopted by the Mechan- icville City Council by Resolution No. 78-14, dat- ed August 20, 2014. 8-26,27 2190
SYNOPSIS OFEMINENT DOMAIN PROCEDURE LAW DETERMINATION AND FINDINGS In accordance with Sec- tion 204 of the New York State Eminent Domain Procedure Law, a synop- sis is hereby given of the Determination and Find- ings regarding the acqui- sition of real property rights required for PIN 1758.94, Frances Street over Anthony Kill Bridge (BIN 2202950), City of Me- chanicville, County of Saratoga, State of New York. THE PUBLIC BENEFITS, USE, OR PURPOSE TO BE SERVED BY THE PRO- POSED PUBLIC PROJECT ARE: The public use to be served by the proposed public project is the re- placement of the Frances Street Bridge over the Anthony Kill. The Frances Street Bridge is owned and maintained by the City of Mechanicville. The benefits to be ob- tained and purposes to be served by the pro- posed public project are as follows: a. Structural Deficien- cies. The existing struc- turally deficient bridge that carries Frances Street over the Anthony Kill would be completely removed and replaced on the existing horizontal and vertical roadway alignment. The replace- ment structure would be designed to current structural /safety stan- dards and provide a serv- ice life of 75 years. b. Hydraulic Design. The selected structure type will improve the hy- draulic conditions of the site for the passage of high stream flows. Por- tions of the retaining wall in close proximity of the bridge will be recon- structed as necessary. c. Utility Relocation. Utilities crossing the An- thony Kill at this location (sanitary sewer, water) will be accommodated on the new structure such that they will be placed above the low structure chord. This will provide utility protection and assurance of contin- ued service during heavy flood events. d. Pedestrians. Pedes- trian safety will be im- proved with ADA compli- ant sidewalk reconstruction within the project limits, including curb ramps and cross- walks at the intersection with North Main Street. THE APPROXIMATE LO- CATION FOR THE PRO- POSED PUBLIC PROJCET AND THE REASONS FOR THE SELECTION OF THAT LOCATION: The proposed public project is located in the City of Mechanicville, Saratoga County, New York. The project limits extend from the intersec- tion of Frances Street and North Main Street on the east to approxi- mately 50 feet beyond the west end of the Frances Street Bridge. Four alternatives were considered for the pro- posed public project. The reasons for selecting Al- ternative D, and for re- jecting the other alterna- tives include: a. The No Build Null Alternative (Alternative A) was rejected because it would not address any of the project objectives. b. The Rehabilitation Alternative (Alternative B). Rehabilitation of the existing structure will not provide for a 75-year service life and no addi- tional improvements would be proposed to the hydraulic opening of the bridge or drainage/safety within the project limits. This alternative would not satisfy the project objectives and is therefore rejected as a feasible alternative. c. Abandonment Alter- native (Alternative C). The abandonment of the existing bridge would in- volve the complete re- moval of the existing structure without re- placement. This alterna- tive is rejected as a feasi- ble alternate because it would not address the project objectives. d. The Replacement Al- ternative (Alternative D) will eliminate the exist- ing structural deficien- cies, be designed to cur- rent structural and safety standards to pro- vide a service life of 75 years, improve the hy- draulic conditions of the site for the passage of high flow events, and im- prove pedestrian safety within the project limits. This alternative best sat- isfies the project objec- tives and is considered the most feasible alter- native. The proposed public project is being progressed as a NEPA Class II Action, Cat- egorical Exclusion with Documentation because it will not, individually or cumulatively, have a sig- nificant environmental impact and is excluded from the requirement to prepare an Environ- mental Impact State- ment (EIS) or an Environ- mental Assessment (EA). As Lead Agency under SEQRA, the City of Me- chanicville determined the proposed project is classified as an Unlisted Action under the SEQRA, Part 617, Title 6 of the Of- ficial Compilation of New York Codes, Rules, and Regulations (6 NYCRR Part 617). The city and its consultant prepared the Draft Short Environ- mental Assessment Form and the city has de- termined the proposed public project will not re- sult in any significant ad- verse environmental im- pacts and has issued a Negative Declaration for the project. The proposed public project will have, among other things, the follow- ing effects upon the resi- dents of the locality: a. Access to adjacent parcels would not be sig- nificantly impacted. Driveways will be main- tained during construc- tion, except for tempo- rary closures of entrances as required by construction activities. b. The proposed pubic project will result in the temporary closing of the Frances Street Bridge to all vehicular and pedes- trian traffic. The pro- posed vehicular detour is approximately 0.85 miles in length. The proposed pedestrian detour is ap- proximately 0.3 miles in length. c. The impact to local businesses is not ex- pected to be significant during construction acti- vities due to the pro- posed traffic control scheme which will main- tain access and mobility through the corridor with only temporary delays. d. The proposed public project will result in the displacement of two small businesses. The City of Mechanicville will provide relocation as- sistance in accordance with the requirements of 49 CFR Part 24, Subparts C and D. e. Temporary increase in noise levels may also be noted by nearby resi- dents; however, con- struction noise will be minimized to the extent possible and will only be noticeable during the hours of active construc- tion (day time). RESOLUTION The foregoing Determi- nation and Findings were adopted by the Mechan- icville City Council by Resolution No. 77-14, dat- ed August 20, 2014. 8-26,27 2186

The Miraculous Prayer, Dear heart of Jesus, in the past I have asked for many favors. This time I ask you for this very special one (men- tion the favor). Take it Dear Jesus and place it within your own broken heart, where your fa- ther sees it, then in our merciful eyes, it will be- come your favor, not mine. Amen. Say prayer for 3 days, promise publication and your favor will be granted. Never known to fail. BOD
